1. Acceptance of Terms

By accessing or using Pit Board Dirt ("App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App. These terms apply to all users of the App.

2. Description of Service

Pit Board Dirt is a racing setup management tool designed for dirt late model racing teams. The App provides tools for managing setup sheets, lap times, tire temperatures, weather conditions, shock data, and related racing information. The App is provided "as is" and may be updated or modified at any time.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate and complete information when creating your account
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with others
  • Be responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorized access to any part of the App or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to infringe on any third-party intellectual property rights
  • Resell or redistribute the App or its content without written permission

5. Your Data

You retain ownership of all racing data, setup sheets, and other content you create in the App. By using the App, you grant us a limited license to store and process your data solely for the purpose of providing the App's services. We do not claim ownership of your data and will not use it for any purpose other than operating the App.

6. Subscription Plans & Billing

Pit Board Dirt offers four subscription tiers: Free Member, Beginner, Advanced, and Crew Chief. Each tier provides access to different features as described on the Pricing page.

Current pricing (subject to change with 30 days notice):

  • Beginner: $4.99/month or $49.99/year
  • Advanced: $9.99/month or $99.99/year
  • Crew Chief: $19.99/month or $199.99/year
  • Subscriptions are billed monthly or annually as selected at checkout
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You may cancel your subscription at any time through Account Settings or through your device's subscription management settings
  • Cancellation takes effect at the end of the current billing period; you retain access until then
  • You may upgrade or downgrade your plan at any time through Account Settings
  • Downgrading may result in loss of access to features not included in the lower tier
  • All subscriptions are billed immediately upon checkout — there are no free trials
  • We reserve the right to modify pricing with 30 days advance notice to active subscribers
  • AI query limits reset on the first day of each calendar month

7. AI-Powered Features

The App includes AI-powered features such as lap time scanning, tire temp extraction, and setup recommendations. These features are provided as tools to assist your decision-making and should not be solely relied upon for critical racing decisions. AI outputs may contain errors and should always be verified by qualified personnel.

8. Account Deletion

You may delete your account at any time through Account Settings → Settings tab → Delete My Account. Deleting your account will permanently remove all your data from our servers and immediately cancel any active subscription. This action cannot be undone. You will not receive a refund for any unused portion of a paid billing period.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE APP IS AT YOUR SOLE RISK. WE ARE NOT RESPONSIBLE FOR ANY RACING OUTCOMES, VEHICLE DAMAGE, OR PERSONAL INJURY RESULTING FROM USE OF THE APP OR RELIANCE ON ITS DATA.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

11. Termination

We reserve the right to terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through Account Settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable law.
